1. Definitions

- Customer refers to any individual, business, or entity that uses Logistrace services.
- Shipment means any goods, cargo, package, or freight transported using our services.
- Services include freight transportation, shipment tracking, warehousing, last-mile delivery, logistics management, and related support services.
2. Scope of Services
Logistrace provides logistics and transportation services including but not limited to:
- Freight forwarding
- Parcel and cargo transportation
- Shipment tracking solutions
- Warehousing and storage
- Customs coordination (where applicable)
- Supply chain logistics support
Services may vary depending on geographic availability and contractual agreements.
3. Customer Responsibilities
Customers agree to:
- Provide accurate shipment information including weight, dimensions, and content.
- Ensure all shipments comply with local and international laws and regulations.
- Properly package goods to prevent damage during transit.
- Ensure that shipments do not contain prohibited or restricted items.
Customers are solely responsible for any legal consequences arising from misdeclared or illegal goods.
4. Prohibited Items
Logistrace does not accept shipments containing:
- Illegal goods or substances
- Hazardous materials (unless pre-approved)
- Weapons or explosives
- Counterfeit goods
- Perishable goods without proper packaging
- Any items restricted by applicable transport laws
Logistrace reserves the right to refuse, suspend, or dispose of shipments that violate these restrictions.
5. Shipment Processing and Delivery
- Delivery timelines are estimates and are not guaranteed unless explicitly stated in a written agreement.
- Delays may occur due to customs inspections, weather conditions, transportation disruptions, or other factors beyond our control.
- Logistrace is not liable for delays caused by force majeure events.
6. Pricing and Payment
- Service fees are based on shipment weight, size, distance, service type, and additional logistics requirements.
- All invoices must be paid according to the payment terms stated on the invoice.
- Late payments may result in service suspension or additional charges.
- Logistrace reserves the right to adjust pricing with prior notice.
7. Tracking Services
Logistrace may provide shipment tracking through its digital platforms.
- Tracking information is provided for convenience and may not always reflect real-time updates.
- Logistrace is not responsible for technical disruptions affecting tracking systems.
8. Liability and Limitations
Logistrace’s liability for loss or damage to shipments is limited to the lesser of:
- The declared value of the shipment, or
- The maximum liability amount defined in the shipping contract.
Logistrace is not liable for:
- Indirect or consequential damages
- Loss of profit or business interruption
- Damage caused by improper packaging by the customer
- Customs delays or government actions
Customers may purchase additional insurance where available.
9. Claims for Loss or Damage
To file a claim:
- Claims must be submitted within 7–14 days after delivery or expected delivery date.
- Supporting documentation may include invoices, photos, proof of value, and shipment details.
- Logistrace reserves the right to investigate all claims.
10. Customs and Regulatory Compliance
For international shipments:
- Customers are responsible for providing accurate customs documentation.
- Duties, taxes, and import fees are the responsibility of the recipient unless otherwise agreed.
- Logistrace may act as a customs intermediary but does not guarantee customs clearance.
11. Warehousing and Storage
Where storage services are provided:
- Storage fees may apply after a specified free storage period.
- Logistrace reserves the right to charge additional handling or storage fees for unclaimed shipments.
12. Force Majeure
Logistrace is not liable for failure or delay in performing obligations due to events beyond reasonable control, including but not limited to:
- Natural disasters
- War or civil unrest
- Labor strikes
- Government restrictions
- Transportation disruptions
13. Data and Privacy
Logistrace collects and processes customer information necessary to provide logistics services, including:
- Shipment details
- Contact information
- Delivery addresses
All personal data is handled in accordance with applicable data protection laws and our Privacy Policy.
14. Termination of Services
Logistrace reserves the right to suspend or terminate services if:
- The customer violates these Terms
- Payment obligations are not met
- Illegal or prohibited goods are shipped
15. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which Logistrace is registered, unless otherwise required by applicable law.
16. Amendments
Logistrace may update these Terms and Conditions at any time. Updated terms will be posted on our website and become effective upon publication.
